Privacy Policy

Bloom&Co. Inc. (the “Company”) sets forth this Privacy Policy (this “Policy”) with regard to the management of user information, including but not limited to personal information defined in Act on the Protection of Personal Information of Japan , in the course of the performance of “PIGUCHI” application provided by the Company (“PIGUCHI”), as follows;

1. User Information to be Collected and Method of Collection

In this Policy, “User Information” means information identifying users, history of actions in PIGUCHI and other information created or accumulated in relation to users or their devices, that are collected by the Company pursuant to this Policy.

The User Information that the Company may collect in the course of the user’s use of PIGUCHI is as follows, depending on the method of collection.

(1)Information provided by the user

The information to be provided by the user for or through the use of PIGUCHI is as follows:

name, sex, and other profile information of the user and his/her child;
e-mail address; and
information transmitted by the user through entry forms or other methods specified by the Company.

(2)Information automatically collected by the Company in the course of the user's use of PIGUCHI

The Company may collect information regarding access to or use of PIGUCHI, which includes the following.

referer
IP address
information regarding server access logs
cookies, ADID, IDFA and other identifiers

2.Purpose of Use

Specific purposes of use of the User Information for the provision of PIGUCHI are as follows:

(1)provision, maintenance, protection and improvement of PIGUCHI, including but not limited to acceptance of registration for PIGUCHI, identification, authentication, and record of user settings that are related to PIGUCHI;
(2)measurement of traffic and actions of the user;
(3)guidance and response to inquiries relating to PIGUCHI;
(4)Development and implementation of products, services, campaigns, etc. based on analysis of user browsing history and other information;
(5)Creation of anonymously processed information and statistical data that does not identify the user with respect to the user's browsing history and other information. To research and analyze marketing data using such information and to disclose the results of such analysis;
(6)Delivery of targeted advertising based on analysis of user browsing history and other information in response to user interests;
(7)addressing a violation of rules, regulations or policies of the Company relating to PIGUCHI (the “Rules”); and
(8)notice of modification to the Rules or related matters.

3.Method of Requiring Discontinuance of Use

The user may require the Company to discontinue the collection or use of the all or a part of the User Information by choosing the applicable setting as prescribed in PIGUCHI, and promptly upon such request the Company shall discontinue such collection or use in accordance with the rules prescribed by the Company. Certain User Information is necessary to be collected or used for providing PIGUCHI, and the Company shall discontinue such collection or use of the User Information only if the user discontinue to use PIGUCHI pursuant to the procedures as determined by the Company.

4.Measures Concerning Safety Management

(1)The Company shall keep personal data accurate and up-to-date to the extent necessary to achieve the purpose of use, and shall endeavor to delete such personal data when it is no longer needed;
(2)We shall take necessary and appropriate measures to prevent leakage, loss, or damage of personal data handled by us, and to otherwise safely manage personal data;
(3)When we have our employees handle personal data, we will provide necessary and appropriate supervision of those employees to ensure the safe management of said personal data;
(4)In order to facilitate our business and provide better services to users, we may entrust the handling of all or part of the personal data obtained from users to a third party. In such cases, we will enter into a confidentiality agreement with the third party in advance that conforms to this policy, and will provide necessary and appropriate supervision to ensure that the third party appropriately manages the information in a secure manner. The subcontractor will use personal data only to the extent necessary to perform the subcontracted work, and will not use it for any other purpose;and
(5)We may have subcontractors in foreign countries handle personal data, have employees in foreign countries handle personal data, use cloud services of third parties in foreign countries, or store personal data on servers located in foreign countries. We will be aware of the personal data protection systems in such foreign countries and take necessary and appropriate measures for the safe management of personal data.

5.Using Google Analytics

PIGUCHI uses Google Analytics, a service provided by Google, Inc. for the purpose of improving application development. When we use Google Analytics within our apps, Google collects, records, and analyzes information about users' behavior within the apps based on cookies issued by us. We receive the results of this analysis from Google to understand the user's in-app behavior.Google Analytics collects user information without including personally identifiable information.Such information will be managed in accordance with Google's privacy policy and other regulations.

6. Provision of Personal Data to Third Parties

We will not disclose retained personal data, among user information, to any third party (including parties located outside Japan) without obtaining the prior consent of the user.However, the following needs must be met by a third party (including parties located outside of Japan) for the following reasons:

(1) When we outsource all or part of the handling of retained personal data within the scope necessary to achieve the purpose of use;
(2) Where retained personal data is provided as a result of the succession of business due to a merger or other reasons;
(3) When retained personal data is provided to a business partner or information collection module provider in accordance with the provisions of Paragraph 5;
(4) The Company is required to cooperate with state or local governmental organizations or their agents to perform their duties or obligations pursuant to applicable laws and regulations, and such performance is likely to be precluded if the consent of the user is essential; and
(5) In addition to the foregoing, the Company is entitled to provide information pursuant to the Act on the Protection of Personal Information of Japan (the “Act”) or other applicable laws and regulations.

7. Disclosure of Retained Personal Data

7-1 When a user requests disclosure of retained personal data or records of provision of personal information to third parties in accordance with the provisions of the Personal Information Protection Law, we will disclose the information to the user without delay after confirming that the request is made by the user himself/herself (if the relevant personal information does not exist, we will notify the user to that effect). The following is a list of our employees.However, this does not apply to cases in which we are not obligated to disclose such information under the Personal Information Protection Law or other laws and regulations.
7-2 Users who wish to request disclosure of the above information must submit the prescribed form for requesting disclosure of personal information and the following identification documents. Please note that a handling fee of 1,000 yen (excluding tax) per request will be charged.

(1) Either of the following document:
- Copy of your passport; or
- Copy of your driver’s license (both sides)
(2) Either two of the following documents:
- Copy of health insurance card
- Copy of pension book
- Original of resident’s card
- Original of seal certificate

8. Correction and Suspension of Use of Retained Personal Data

8-1 We will not disclose personal information to any third party without the prior consent of the user if (1) the user requests correction of the retained personal data in accordance with the provisions of the Personal Information Protection Law on the grounds that the data is not true, or (2) the data has been collected for reasons beyond the scope of the purpose of use that has been publicly announced in advance or by deception or other wrongful means. In the event that a user requests that the use of his/her personal data be discontinued in accordance with the provisions of the Personal Information Protection Law, we will conduct the necessary investigation without delay after confirming that the request is made by the user himself/herself, and based on the results, we will correct the content of the retained personal data or discontinue its use, and notify the user of such correction or discontinuance. If we decide not to correct or suspend the use of the retained personal data, we will notify the user to that effect.

8-2 If a user requests that we erase his/her personal data, and if we deem it necessary to comply with the request, we will erase the personal data after confirming that the request is made by the user himself/herself, and notify the user to that effect.

8-3 Should the Company not be obligated to correct, or suspend use of, information under the Act and other applicable laws and regulations, Sections 8.1 and 8.2 shall not apply.

10. Procedure to Amend this Privacy Policy

The Company may amend this Policy as necessary; provided, however, that in the event of an amendment to this Policy that legally requires the consent thereto of the users, this Policy after the amendment shall be applied only to those who have given the consent in the manner specified by the Company. In the event of any amendments to this Privacy Policy, the Company shall inform the effective time and content of the amended Policy by posting on the website of the Company or other appropriate way, or notify the user of the same.
